The European Law Association is excited to invite you all to a discussion this Friday, November 13rd at 12-1pm on the growing threats to an independent judiciary in Europe. We are delighted to welcome former Polish Constitutional Court Judge Mirosław Wyrzykowski, and Professor L. Pech, Professor of European Law at the University of Middlesex in London. They will be joined by Judge Lech Garlicki, a former judge on both the Polish Constitutional Court and European Court of Human Rights, as well as Arthur Liman Professor of Law at Yale, Judith Resnik.

The speakers will engage with the independence of the judiciary in the EU, and the enormous pressure that it has been under in recent years. In Poland, the ruling Law & Justice Party (PiS) have taken numerous steps to undermine the separation of powers, including stuffing the Polish court system with illegally-appointed and unqualified judges, and threatening other members of the bench with disciplinary action and even criminal prosecution. Our panelists, Judge Wyrzykowski and Professor Pech, will address the causes and consequences of these developments, as well as the institutional reaction of the European Union. With additional commentary and questions from our discussants, Judge Garlicki and Professor Resnik, we hope to have a robust discussion about the tactics, political rhetoric, and legal arguments used to subdue the judiciary and subject it to the will of the Polish government.
